Before buyers firm up on a townhouse, he checks how it is owned, who maintains what, and what that means for the monthly budget.

What should you check before buying a freehold or condo townhouse in Markham

Start with the legal description. Words such as “POTL,” “CECC” or “undivided interest in common elements” mean the home is tied to a condominium corporation, even if it is marketed as freehold. For any condo or POTL townhouse, review the status certificate, which in Ontario costs up to $100 and must be delivered within 10 days. Confirm the monthly fee and what it covers, who maintains private roads and laneways, and whether a driveway is shared under a registered right-of-way. In September 2026, Markham freehold townhouses had a median of $918,490 and condo townhouses $735,000, according to TRREB.

Many Markham townhomes look identical from the street. The ownership is in the paperwork. Ask your REALTOR® and lawyer to confirm which of these you are buying:

If the description says It usually means
A lot or part of a lot on a registered plan, no condo reference Freehold
“Unit” and “level” in a condominium plan Condo townhouse
“POTL,” “CECC” or an interest in common elements Freehold parcel tied to a common elements condominium

With a POTL, the interest in the common elements cannot be separated from your home when you sell, and the corporation can register a lien if fees go unpaid. Buyers sometimes assume these homes are fully freehold, so confirm before you offer.

Fees: What They Cover and What They Cost You

Fees vary widely. Three Markham condo townhouse listings on condos.ca in 2026 showed how different they can be:

Listing (2026) Monthly fee What the fee included
Camelot Way, 1,200 to 1,399 sq ft $498 Cable, insurance, parking, water, lawn, snow
Feeney Lane, 1,400 to 1,599 sq ft $297 Internet, lawn, snow
Roy Grove Way, 1,800 to 1,999 sq ft $179 Insurance, garbage, snow in common areas

A lower fee is not always the better deal. Compare what is included, who pays for roofs, windows and driveways, and how healthy the reserve fund is. Lenders also count condo and POTL fees when they calculate how much you can borrow.

The Status Certificate

For condo and POTL townhomes, the status certificate is the most important document after the agreement itself. The Condominium Authority of Ontario says it costs up to $100 including tax and must be delivered within 10 days. Your lawyer should review:

  • The current fee and any planned increase
  • The reserve fund balance and the latest reserve fund study
  • Any special assessments or lawsuits
  • Rules on rentals, pets, parking and renovations

For the warning signs to watch for, see status certificate red flags.

Shared Roads, Laneways and Driveways

Setup Who usually maintains it What to check
Private road in a condo or POTL community The corporation, paid through fees Snow, paving and repair plans in the reserve fund
Public rear laneway City of Markham Lanes are plowed with local roads, the lowest priority
Mutual driveway between two homes Both owners, under a registered right-of-way The survey and title, and how the drive is used in practice

The City of Markham plows local roads and lanes once snow reaches about 7.5 cm, and says clearing all local streets can take up to about 16 hours. Rear-lane homes are not included in the City’s windrow clearing program. Shared driveways deserve care: Toronto real estate lawyer Bob Aaron has written about driveway disputes in which the losing neighbour was ordered to pay about $75,000 in legal costs.

What Drives Resale Value

  • Ownership type and fees. Freehold and low-fee POTL homes often appeal to a wide pool of buyers.
  • Parking. A garage plus a driveway space matters in family communities.
  • End units. More windows and side yards usually attract more interest.
  • Location within the complex. Units backing onto busy roads or facing visitor parking can be harder to sell.
  • Reserve fund health. A special assessment on the horizon can scare future buyers.

In September 2026, TRREB recorded 30 freehold townhouse sales and 23 condo townhouse sales in Markham.

Before You Offer: A Townhouse Checklist

  1. Confirm the ownership type in the legal description.
  2. Get the monthly fee and a list of what it covers.
  3. Make your offer conditional on your lawyer’s review of the status certificate, where one applies.
  4. Ask who maintains the roof, windows, road, laneway and snow.
  5. Check the survey for any shared driveway or right-of-way.
  6. Include fees in your mortgage pre-approval.

Ultimately, the decision is yours. The goal is to make sure you have all the information before you buy.
